Cuatro hermanos originarios de Nueva Imperial y residentes desde hace algún tiempo en Rancagua y Curicó, pasaron seis meses en prisión, acusados de secuestro y extorsión por quien robó un animal en la casa de sus padres, en el sur de Chile

La historia parece sacada de la crónica más oscura de los atropellos del Estado contra miembros del pueblo mapuche, aquella de los tiempos del far west montado en la época de la pacificación de la Araucanía.
Pero es un hecho que está aconteciendo ahora.
Tres hermanas y un hermano de la familia Landeros Hueche, originarias de una comunidad rural de Nueva Imperial, estuvieron detenidas en Rancagua, ellas, en Curicó, él, acusados de robar y extorsionar. En ambas ciudades, l@s herman@s conformaron familia hace ya algún tiempo.
L@s cuatro habían viajado a comienzos de septiembre pasado desde el centro a la casa paterna en el sur, para celebrar el cumpleaños del progenitor. En los días previos, tuvieron noticia del robo de un buey que habían sufrido sus padres. Viajaron, entonces, con la idea de ver cómo resolvían esta situación que afectaba al trabajo diario del jefe de familia, un adulto mayor de 66 años.
A la usanza del pueblo, una vez llegados a Nueva Imperial, indagaron entre sus conocidos en la comunidad sobre el robo del animal. Les costó poco enterarse del nombre y domicilio del ladrón, en las proximidades de Nueva Imperial. Lo encararon a él y a su madre, le reprocharon su conducta, le comunicaron que lo denunciarían a Carabineros y, dado que el ladrón tenía antecedentes, rogó a los hermanos que se desistieran de la denuncia. Llegaron a un acuerdo: como ya no tenía el animal, se comprometieron a devolverles un millón quinientos mil pesos, cifra inferior al costo real del buey, que transfirieron a una cuenta de la familia afectada.
Hasta aquí, problema solucionado.
Sin embargo, días después de su regreso a Curicó y Rancagua, l@s cuatro herman@s fueron sacad@s de sus casas, detenidos y encerrados en las cárceles de ambas ciudades, acusad@s de secuestro y extorsión. El ladrón los había denunciado y la Fiscalía gestionó la acción policial que se tradujo en seis meses de presidio para l@s cuatr@ herman@s. 180 días en que no pudieron ver a sus hijos, todos menores de edad. 180 días privadas de libertad sin la más mínima conciencia de culpa. 128 días con sus horas en que la Fiscalía no contrastó sus versiones con la acusación del ladrón ni investigó lo acontecido.
Recién el martes pasado, el tribunal modificó la medida cautelar de las tres hermanas, y dispuso la detención domiciliaria. En los días previos a la vista de la causa, la Fiscalía les había ofrecido un juicio abreviado, bajo una condición inaceptable para ellas: declararse culpables.
Cierto es que las dudas arrancan desde que se supo que el fiscal estuvo involucrado en el caso Huracán. Como cierto es que el método de control del desempeño del Ministerio Público se basa sobre causas cerradas o archivadas, lo que podría explicar la prisa porque las hermanas se declararan culpables.
Más importante que eso, sin embargo, es que el caso exuda el mal aire de una justicia parcial con personas pobres y de pueblos originarios. ¿Una más del Estado en sus exacciones con quienes han padecido más de un siglo la parcialidad de sus instituciones? Sí. Lo que sorprende es que suceda en el momento que vive Chile, en medio de un rediseño constitucional que busca una nueva relación con los pueblos originarios. En la última línea, cuatro hermanos, tres madres, fueron separadas de sus hijos y privadas de libertad por largos 180 días y no se prestó atención a su versión. Primó más el interés del fiscal.
