El 30 de marzo de 2022, el pleno de la Convención Constitucional ha rechazado en votación particular la inclusión en el artículo 18 de la nueva Constitución, referido al derecho de propiedad, del histórico párrafo de la Nacionalización del Cobre, presentado por el presidente Salvador Allende —aprobado por la unanimidad del Congreso en 1971— y que ni siquiera la Constitución de Pinochet se atrevió a tocar. Dicho párrafo, según lo había propuesto y aprobado la Comisión de Derechos Fundamentales de la propia Convención Constitucional, e incluido, además, en la propuesta de norma entregada por la Confederación de Trabajadores del Cobre, reproducía textualmente:
“El Estado tiene el dominio absoluto, exclusivo, inalienable e imprescriptible de todas las minas, comprendiéndose en estas las covaderas, las arenas metalíferas, los salares, los depósitos de carbón e hidrocarburos y las demás sustancias fósiles, con excepción de las arcillas superficiales, no obstante la propiedad de las personas naturales o jurídicas sobre los terrenos en cuyas entrañas estuvieren situadas. Los predios superficiales estarán sujetos a las obligaciones y limitaciones que la ley señale para facilitar la exploración, la explotación y el beneficio de dichas minas.”
Entendemos que la Convención Constitucional ha debido enfrentar una enorme presión en la difícil, pero imprescindible tarea de alcanzar amplios consensos respecto de todas las materias. Pero, como organización nacional de las y los trabajadores contratistas y subcontratistas del cobre, nos cabe el deber moral de hacer presente a la Convención y al país, que el rechazo a incluir el histórico párrafo en el articulado de la nueva Constitución tiene gravísimas implicancias:
Primero: resulta ser una imprudente falta de respeto a la memoria histórica de nuestro país, y a la culminación, en el gobierno popular encabezado por Salvador Allende, de las luchas del pueblo y los trabajadores por la recuperación de los recursos mineros entonces entregados al capital estadounidense.
Segundo: deja sin respuesta a una de las exigencias actuales más sentidas y transversales del pueblo de Chile, como es la de recuperar la soberanía sobre nuestros recursos mineros estratégicos y rescatar los recursos necesarios para las grandes transformaciones que el país necesita.
Tercero: debilita la soberanía nacional, al mantener las puertas abiertas a la continuidad del modelo neoliberal, privatizador, depredador y extractivista, que las grandes movilizaciones populares nos han mandatado a superar y que, con un vacío de tal magnitud en la Constitución política de Chile, permitiría a la minería transnacional acabar exterminando, sin remedio, un recurso que por naturaleza no es renovable.
Por tales motivos, exigimos que este histórico párrafo sea incluido textualmente en el más alto nivel de la nueva Constitución y que, el conjunto de la misma, se adecúe a su espíritu, ordenando de este modo la renacionalización del cobre y nuestros bienes comunes estratégicos, hoy entregados al capital privado transnacional en flagrante violación de los intereses nacionales.
Ello constituye la condición esencial para recuperar la soberanía y dignidad del pueblo, porque bien sabemos que quién controla el cobre, controla Chile.
