A lo largo de nuestra historia, los hechos dan cuenta de la violencia estructural con la que han administrado nuestro país diversos gobiernos, y los recursos hídricos no han sido la excepción. El estado y su normativa ha permitido implementar un modelo donde solo unos pocos se benefician del recurso, llegando a niveles extremos, en el que el ecosistema y la vida, como la conocemos, podría ser inviable por la falta de agua.
María Segura, Ignacio Ovando, Julio Farias, Ma Teresa Ríos*
Haciendo un somero análisis sobre el uso del agua en Chile y sus graves consecuencias políticas, sociales y ecológicas, observamos que su administración tiene un común denominador. Se privilegió el interés particular por sobre el de la comunidad, dejando regiones completamente desabastecidas de agua y saqueadas, por parte de grupos económicos. El estallido social y la esperanza que nos trae la nueva Constitución, son consecuencias del trato inequitativo existente a lo largo de nuestra historia.
El Código Civil de 1855, realizó la primera clasificación de las aguas, iniciando así los primeros conflictos público/privados por el uso del agua. No fue hasta el año 1951 donde se dicta el primer Código de Aguas, estableciendo el “derecho de aprovechamiento”, que beneficia a los privados, respecto al uso y goce sin mayores restricciones. La primera gran reforma absoluta, se dio con la implementación de la “Reforma Agraria” de 1967, cuya composición modificaba la estructura de aprovechamiento del agua, dando vida a un nuevo Código, el que puso en primer orden el interés de la comunidad (colectividad) por sobre el individuo.
Con el golpe de Estado y la dictadura militar, en 1979, mediante el Decreto Ley Nro. 2603, se realiza una segunda reforma al código de aguas, esta vez cambiando su visión sobre su uso y goce, pasando este de ser un bien de uso público a un RECURSO, regresando los derechos de aprovechamiento de agua a los titulares, a quienes se les expropió durante la Reforma Agraria. Con la Constitución del 80 y el nuevo Código de Aguas de 1981, se instauró la legitimidad del derecho de aprovechamiento de agua, generando hasta el día de hoy problemas respecto de este recurso vital para la subsistencia de la humanidad.
En el norte de nuestro país, comunidades indígenas y campesinas se confrontaron a empresas mineras, cuyo resultado significó la paulatina y consecuente migración de la población a la ciudad, producto de la imposibilidad de realizar sus actividades productivas por la falta de este recurso.
Lejos de solucionarse, el acceso al agua es un problema estructural en nuestro país que deriva del modelo de gestión, donde su asignación se basa en criterios de mercado, sometiendo estos a una fuerte presión en aquellos lugares en el que el recurso hídrico es más escaso. Los diferentes usos y derechos de las propiedades del agua quedan en manos de la “libre competencia”, lo que favorece, en gran medida, al aprovechamiento y concentración de su uso, como es el derecho de propiedad con el que cuentan las empresas del sector eléctrico, minero y exportador, grandes motores de la economía a nivel nacional.
La escasez hídrica es un hecho. En nuestro país, más de 8 millones de personas viven con racionamiento de agua. Según expertos, estamos frente a un daño irreversible al planeta. Es así como se cree que ya no debemos hablar de Cambio Climático, sino que derechamente de Crisis Climática. Este fenómeno también supone riesgos para la gestión energética, la salud de las personas, la seguridad alimentaria, el desarrollo económico y el trabajo para la reducción de la pobreza.
Audrey Azoulay, directora general de la Unesco, nos menciona, en el Informe Mundial de las Naciones Unidas sobre el Desarrollo de los Recursos Hídricos: No dejar a nadie atrás (2019), que “es mucho lo que hay en juego: casi un tercio de la población mundial no tiene acceso a servicios de agua potable administrados de manera segura, es decir, que solo dos tercios de la población mundial tienen acceso a estos servicios. La intensificación de la degradación ambiental, el cambio climático, el crecimiento demográfico y la rápida urbanización, entre otros factores, también plantean desafíos considerables para la seguridad hídrica. Además, en un mundo cada vez más globalizado, el impacto de las decisiones relacionadas con el agua traspasa las fronteras y afecta a todos”.
El Estado de Chile, a partir de la Constitución de 1980, ha colaborado en perpetuar el modelo económico neoliberal, reconocido por ser extractivista de los recursos naturales, bajo la premisa de que estos son considerados inagotables. Trabajando sobre esa tesis, es necesario evaluar si representa un recurso natural que es de todos los chilenos, o aquello sobre lo cual cada habitante depende para subsistir, lo que -según el análisis de la normativa- sería inconsistente, por cuanto los procesos de liberalización y privatización del agua, han transformado este recurso hídrico desde un bien nacional de uso público hacia un bien económico. Este, actualmente, se encuentra sujeto a las reglas de mercado y cuya mercantilización ha permitido generar las inequidades y desastre ecológicos.
Los cambios introducidos en democracia al Código de Aguas fueron en su mayoría estéticos o para beneficio del grupo que siempre ha usufructuado de ellos. Es, en definitiva, una muestra más de la violencia institucionalizada de nuestro país. Presidentes, ministros, diputados y senadores establecen en su discurso la preocupación por resolver la crisis hídrica de nuestro país. Sin embargo, a la hora de la votación siempre se aprobaban los artículos que nada resolvían respecto del tema estructural, dejando para después lo coyuntural. Podrán argumentar que estos eran complejos, difíciles, que no se contaba con las mayorías necesarias, pero lo cierto es que el Estado no es garante de este servicio para sus habitantes. Determinar si fue por negligencia inexcusable o por dolo -recordando a Andrés Bello en el Código Civil- no es relevante, pues el resultado es el mismo: ya sea por lo uno o por lo otro, el hecho es que Chile es hoy uno de los países que enfrenta las consecuencias más graves de la Crisis Climática.
Una de las reclamaciones más importantes del estallido social fue el uso del agua. Era de esperarse, entonces, que este sería un tema transversal en el desarrollo del trabajo de la Convención Constitucional. El borrador de nueva Constitución nos propone una nueva institucionalidad y mirada respecto al agua, poniendo en el centro la consagración como un derecho humano, declarándose como inapropiables e incomerciables. Respecto de la institucionalidad, vemos como un hecho positivo que cambie la actual Dirección General de Aguas (DGA) por una Agencia Nacional del Agua, que junto al Consejo de Cuenca reúne a todos los actores involucrados logrando plena participación para su gestión, en momentos tan cruciales como el que estamos viviendo. Claramente, el actuar del Estado, en las últimas décadas, ha sido insuficiente para enfrentar crisis que tienen a poblados enteros con pequeños agricultores que pierden su sustento, obligándolos a nuevas migraciones hacia una ciudad sobreexplotada que no le ofrece un mejor bienestar. Como es habitual, el mismo sector que defiende el mercado hoy nos dice que afectará mucho a la generación de energía, sector productivo y minero, sin explicarnos qué harán las futuras generaciones con luz y cobre, pero sin agua. Creemos que no lo explican, porque nunca han mirado la vida humana como lo más importante en el desarrollo de un país. Con estas modificaciones, se pone nuevamente en el Estado el rol de garante de la vida, de custodiar los recursos del país, rol que no ha cumplido en los últimos 45 años.
