Sobre una nueva Constitución para Chile – Parte 2

Derechos fundamentales y garantías.

Artículo 21 (SOBRE TRATOS CRUELES, TORTURA Y CONDENA A MUERTE)

  1. […] Ninguna persona puede ser condenada a muerte o ejecutada, sometida a torturas, ni penas ni tratos crueles, inhumanos o degradantes.

No hay pena de muerte en Chile (algo no de ahora), y se eleva a rango constitucional la prohibición de la tortura y otros tratos degradantes hacia el ser humano. Un Estado como el nuestro, no puede dejar de condenar la práctica de la tortura, ejecuciones y lo señalado.

Artículo 22 (ACTOS IMPRESCRIPTIBLES E INAMNISTIABLES)

Ninguna persona será sometida a desaparición forzada. Toda víctima tiene derecho a ser buscada y el Estado dispondrá de todos los medios necesarios para ello.

Artículo 24

  1. […] La desaparición forzada, la tortura y otras penas a tratos crueles, inhumanos o degradantes, los crímenes de guerra, los crímenes de lesa humanidad, el genocidio y el crimen de agresión son imprescriptibles e inamnistiables.

Se explicitan los actos imprescriptibles e inamnistiables. Quien pase a llevar lo señalado en este artículo, sabrá que, aun pasado el tiempo, los actos cometidos no prescribirán ni podrán ser amnistiados y serán juzgados de acuerdo a lo que fueron.

Artículo 25 (DISCRIMINACIÓN)

  1. […] En Chile no hay persona ni grupo privilegiado. Queda prohibida toda forma de esclavitud. […]
  2. Está prohibida toda forma de discriminación, en especial cuando se funda en uno o más motivos tales como nacionalidad o apatridia, edad, sexo, características sexuales, orientación sexual o afectiva, identidad y expresión de género, diversidad corporal, religión o creencia, raza, pertenencia a un pueblo o nación indígena o tribal, opiniones políticas o de otra naturaleza, clase social, ruralidad, situación migratoria o de refugio, discapacidad, condición de salud mental o física, estado civil, filiación o condición social, y cualquier otra que tenga por objeto o resultado anular o menoscabar la dignidad humana, el goce y ejercicio de los derechos.

En Chile se prohíbe la esclavitud (aun en sus formas contemporáneas: ejemplo, trabajos de personas en condiciones que no respetan la dignidad del ser humano). Se dice No a la discriminación en cualquiera de sus formas, especialmente las señaladas expresamente. Esto nos parece muy bien en el contexto de una sociedad justa e inclusiva.

Artículo 26 (DERECHOS DE NIÑAS, NIÑOS Y ADOLESCENTES)

  1. Niñas, niños y adolescentes son titulares de los derechos establecidos en esta Constitución y en los tratados internacionales de derechos humanos ratificados y vigentes en Chile. […]
  2. Asimismo, tienen derecho a protección contra toda forma de violencia, maltrato, abuso, explotación, acoso y negligencia. […]

Se explicitan los derechos de niñas, niños y adolescentes. ¿Quién podría oponerse a ello?

Artículo 27

  1. Todas las mujeres, las niñas, las adolescentes y las personas de las diversidades sexuales y de género tienen derecho a una vida libre de violencia de género en todas sus manifestaciones, tanto en el ámbito público como en el privado, sea que provenga de particulares, instituciones o agentes del Estado.

No a la violencia de género, en el ámbito que sea, público o privado, de particulares o agentes del Estado. Se suma a la no discriminación.

Artículo 28 (PERSONAS CON DISCAPACIDAD)

  1. Las personas con discapacidad son titulares de los derechos establecidos en esta Constitución y en los tratados internacionales de derechos humanos ratificados y vigentes en Chile.
  2. Toda persona con discapacidad tiene derecho al goce y ejercicio de su capacidad jurídica, con apoyos y salvaguardias, según corresponda; a la accesibilidad universal: a la inclusión social; a la inserción laboral, y a la participación política, económica, social y cultural.

Los derechos de las personas con discapacidad, en todos los ámbitos señalados.

Artículo 30 (DERECHOS DE LAS MUJERES Y PERSONAS GESTANTES)

  1. […] Las mujeres y personas gestantes tienen derecho, antes, durante y después del parto, a acceder a los servicios de salud que requieran, a la lactancia y al vínculo directo y permanente con su hija e hijo, teniendo en consideración el interés superior de niñas, niños y adolescentes.

Artículo 33 (PERSONAS MAYORES)

  1. Las personas mayores son titulares de los derechos establecidos en esta Constitución y en los tratados internacionales de derechos humanos ratificados y vigentes en Chile.
  2. Asimismo, tienen derecho a envejecer con dignidad; a obtener prestaciones de seguridad social suficientes para una vida digna; a la accesibilidad al entorno físico, social, económico, cultural y digital; a la participación política y social; a una vida libre de maltrato por motivos de edad; a la autonomía e independencia y al pleno ejercicio de su capacidad jurídica con los apoyos y salvaguardias que correspondan.

Artículo 35 (EDUCACIÓN)

  1. Toda persona tiene derecho a la educación. La educación es un deber primordial e ineludible del Estado. […]

La educación como un derecho universal, deber primordial e ineludible del Estado de la República de Chile.

Artículo 36 (SISTEMA NACIONAL DE EDUCACIÓN)

  1. El Sistema Nacional de Educación está integrado por los establecimientos y las instituciones de educación parvularia, básica, media y superior, creadas o reconocidas por el Estado. […]

4. […] El Sistema Nacional de Educación promueve la diversidad de saberes artísticos, ecológicos, culturales y filosóficos que conviven en el país. […]

7. La educación pública constituye el eje estratégico del Sistema Nacional de Educación. […]

El Sistema Nacional de Educación; la educación pública como eje estratégico de este.

Artículo 37 (EDUCACIÓN SUPERIOR)

1. El Sistema de Educación Superior estará conformado por las universidades, los institutos profesionales, los centros de formación técnica, las academias creadas o reconocidas por el Estado y las escuelas de formación de las policías y las Fuerzas Armadas. Estas instituciones considerarán las necesidades comunales, regionales y nacionales. Tienen prohibida toda forma de lucro. […]

Cómo está conformado el Sistema de Educación Superior, que deberá considerar las necesidades comunales, regionales y de país. Y se añade algo que se opone a la educación concebida como un negocio: prohibición del lucro. Esto provocará a visiones contrarias, pero la educación privada sigue existiendo. La Constitución reconoce el derecho a elegir el tipo de educación al que se aspira.

4. […] En cada región existirá al menos una universidad estatal y una institución de formación técnico profesional de nivel superior estatal. […]

5. El Estado velará por el acceso a la educación superior de todas las personas que cumplan los requisitos establecidos por la ley. […]

6. Los estudios de educación superior conducentes a títulos y grados académicos iniciales serán gratuitos en las instituciones públicas y en aquellas privadas que determine la ley.

Esta Constitución señala que en cada región deberá haber una universidad estatal y un centro de formación técnica; el Estado velará por el acceso a la educación superior de todos quienes cumplan los requisitos (no los del dinero) y se refiere a la gratuidad en los estudios conducentes a títulos y grados académicos iniciales en las instituciones públicas. Una concepción distinta de la educación de mercado.

Artículo 39 (EDUCACIÓN AMBIENTAL, NATURALEZA)

El Estado garantiza una educación ambiental que fortalezca la preservación, la conservación y los cuidados requeridos respecto al medio ambiente y la naturaleza, y que permita formar conciencia ecológica.

Una de las características de esta Constitución es su valoración de la naturaleza, la de su cuidado, preservación; la de formar conciencia ecológica entre los ciudadanos, por la relación que esta tiene, en definitiva, con el bienestar del ser humano, sobre todo en los tiempos del denominado cambio climático. Hemos escuchado, en ocasiones, que esta es una Constitución indigenista, por las menciones de su articulado respecto de los pueblos y naciones indígenas (lo que corresponde, para visibilizar estas culturas que componen parte de la República), pero bien pudiéramos decir que esta es una Constitución ecologista, por la importancia que da al medio ambiente y a la naturaleza.
