Democracia Paritaria

En esta nueva entrega de la abogada Yasna Araya, nos explica qué es una democracia paritaria y el porqué de su importancia. La democracia paritaria no solo exige el reconocimiento de una democracia con igualdad de género, sino que también de toda persona que no atienda a ese binarismo, reconociendo así que no se puede hablar de legitimidad en la representación si, en la práctica, se excluyen a las mujeres o diversidades sexogenéricas, aunque no sea de manera formal.

En Chile, la democracia tiene fuente constitucional, pues sienta sus bases en la Constitución Política de la República, que en su artículo 4º dispone que: “Chile es una república democrática”.

Indicar que una nación o país es una república democrática ha sido una de las mayores consignas de las luchas independentistas, luego de transitar por regímenes de gobierno autodesignados. Así, la idea de una república democrática busca un sistema político en que las máximas autoridades sean electas por la ciudadanía, a través de elecciones directas o indirectas, pero la búsqueda de esa representación tiene que ser por medio de la participación democrática. Se entiende por tal, una participación sin discriminación e igualitaria entre todas las personas, lo cual ha sido un camino largo, de muchos contrastes, luchas, derrotas que aún no acaba. Prueba de lo anterior, han sido las luchas del derecho a voto para toda persona, con independencia de su estatus político-social, etnia o género. La representatividad democrática, a través de la participación de todos, es necesaria para la legitimidad de las decisiones políticas, ya que aquella viene dada por el colectivo social; no por un determinado sector (en el artículo anterior, se explicó que las decisiones políticas se legitimaban no por el cargo detentado, sino porque aquellos venían de un representante al que se le había dado el poder a través de un proceso eleccionario).

No obstante, desde que las mujeres han alcanzado derechos políticos fundamentales, como el derecho a la representación en cargos políticos o el derecho a voto, pareciera que se creó una imagen de suficiencia que, en apariencia, nos muestra que vivimos en un siglo en el que ya no se necesitan más cambios. Supuestamente, se adquirieron todos los derechos necesarios, siendo los que faltan algunos menos o de poca relevancia, mostrando, por ende, una imagen de igualdad entre hombres y mujeres. Pero, la realidad dista de aquello, pues hoy se siguen viendo brechas y desigualdades importantes entre hombres y mujeres, pero, también, entre personas que no atienden a ese convencionalismo binario. Solo, a modo de ejemplo, pensemos en las desigualdades salariales, el encarecimiento de los planes de salud, la disparidad de los cargos asignados, o las desigualdades en derechos de familia. Es por todo ello que, desde hace varios años, se ha estado introduciendo el concepto de democracia paritaria en las discusiones internacionales, ya que aquel concepto de democracia de las luchas independentistas ha quedado con grado de insuficiencia para asegurar una real igualdad entre géneros y personas. Ello, debido a que su lucha (la cual ha sido de gran importancia) se ha centrado en las desigualdades sociales, que se han generado a lo largo de los dos últimos siglos, y en conceptos convencionales del binarismo hombre-mujer. Sin embargo, han obviado el paradójico resultado de la ausencia de mujeres o personas de las que socialmente se le ha llamado de la minoría sexogenérica, en el poder político y su participación en la toma de decisiones.

Es por lo anterior, que este concepto contemporáneo de democracia paritaria es uno de los mayores logros de los movimientos feministas, que han buscado una integración real y efectiva del género, en sociedades donde la disparidad es evidente. Pero, ¿qué es exactamente una democracia paritaria y por qué al hablar de democracia es necesario reclamar que aquella debe ser paritaria? ¿No es paradójico?

El concepto se acuña, quizá, por primera vez, en la Conferencia de Atenas de 1992. En ella, se proclamó la necesidad de una democracia calificada como paritaria, esto es, la total integración, en pie de igualdad de las mujeres en las sociedades democráticas, utilizando para ella las estrategias multidisciplinarias necesarias.

Así, la democracia paritaria ya ha dejado de ser una discusión minimizada, para tomar relevancia e importancia en distintos instrumentos internacionales, donde se ha reconocido su necesidad. A modo de ejemplo, citaré la Declaración de la Comisión de Derechos Humanos de Naciones Unidas, que ha dispuesto que un orden internacional democrático y equitativo requiere, entre otras cosas, el ejercicio de los siguientes derechos: «(…) La promoción y consolidación de instituciones internacionales transparentes, democráticas, justas y responsables en todos los ámbitos de cooperación, en particular por medio de la aplicación de los principios de la participación plena y en condiciones de igualdad en sus respectivos mecanismos de adopción de decisiones; el principio de una representación regional equitativa y equilibrada de hombres y mujeres en la composición del personal de todos los órganos del sistema de las Naciones Unidas; (…)» y «el derecho a la participación política, incluida la igualdad de oportunidades de todos los ciudadanos para presentarse como candidatos». Han habido diversas discusiones internacionales en las que se ha reconocido la existencia de una desigualdad entre hombres y mujeres, y de personas que no atienden a ese binarismo. Por lo mismo, han advertido sobre la necesidad de que distintos órganos y estados implementen un conjunto de medidas que garanticen una equidad real, con el objetivo de compensar las desigualdades sociales, económicas y políticas, que, por años, se ha ido generando, a la luz de las instituciones democráticas. Ello ha provocado una disparidad en el desarrollo social y económico, como también en los accesos igualitarios de las decisiones público-privadas y de poder político.

Por lo anterior, ha sido objeto de debate la incorporación de una democracia paritaria en la nueva Constitución, la que hoy está definida en el primer inciso del artículo 2°: Democracia paritaria. El Estado reconoce y promueve una sociedad en la que mujeres, hombres, diversidades y disidencias sexogenéricas participen en condiciones de igualdad sustantiva, reconociendo que su representación efectiva en el conjunto del proceso democrático es un principio y condición mínima para el ejercicio pleno y sustantivo de la democracia y la ciudadanía. Ella no solo exige el reconocimiento de una democracia con igualdad de género, sino que también de toda persona que no atienda a ese binarismo, reconociendo así que no se puede hablar de legitimidad en la representación si, en la práctica, se excluyen a las mujeres o diversidades sexogenéricas, aunque no sea de manera formal.

En consecuencia, la incorporación del concepto de un Estado con democracia paritaria, aunque suene paradójico o redundante, en su construcción lingüística, viene a reconocer la insuficiencia que ha tenido las democracias liberales, al momento de reconocer, incorporar y hacer exigibles los mismos derechos, tanto para hombres como para mujeres o las personas en su totalidad. Se asegura, para ello, de manera explícita y con rango constitucional, que el Estado adopte las medidas necesarias (inciso 3: Asimismo, el Estado adoptará medidas para la representación de diversidades y disidencias de género a través del mecanismo que establezca la ley. Inciso 4: El Estado promoverá la integración paritaria en sus instituciones y en todos los espacios públicos y privados). Todo lo cual busca que exista una real participación ciudadana sin discriminación (inciso 2: Todos los órganos colegiados del Estado, los órganos autónomos constitucionales y los órganos superiores y directivos de la Administración, así como los directorios de las empresas públicas y semipúblicas, deberán tener una composición paritaria que asegure que, al menos, el cincuenta por ciento de sus integrantes sean mujeres).
