El pasado 23 de diciembre, la Contraloría Regional emitió un informe que desnudó una serie de irregularidades en las contrataciones de personal y compras de bienes que efectuó durante 2021 la Corporación Municipal de Servicios Públicos Traspasados de la Municipalidad de Rancagua. Y aunque parecía que el gran afectado era solo el actual alcalde Juan Ramón Godoy, la auditoría abarcó los últimos meses de su antecesor, el independiente ex UDI Eduardo Soto, que tampoco sale bien librado.

Las recomendaciones del informe de Contraloría que detectó irregularidades en la gestión de compras de bienes y contrataciones de personal de la Corporación Municipal de Rancagua durante 2021, parecían alcanzar solo al actual alcalde, Juan Ramón Godoy. Sin embargo, la sugerencia de que intervengan al Consejo de Defensa del Estado y a la Fiscalía ponen luz sobre el otro actor, hasta ahora en bambalinas, Eduardo Soto, quien desde antes de terminar su período a mediados de 2021, acumulaba ya acusaciones de corrupción. La sugerencia del ministerio público no es irrelevante, porque si la Fiscalía y el Consejo aparecen en escena es porque hay presunción de delito o de daño al patrimonio del fisco.
Por eso es que llamó poderosamente la atención que las notas preparadas por TV 13 sobre el caso ponen el foco sobre Godoy, pero nada dicen sobre el ex edil Soto. Y sobre Soto no es poco lo que pesa: acusaciones de sobresueldos, horas extras, dobles contratos, fragmentación de compras en la corporación municipal; probable malversación de caudales públicos y eventuales nexos de extorsión en el Teatro Regional e irregularidades en la gestión de las obras de Paseo Estado, el proyecto de techumbre de la medialuna y dobles contratos, entre otros, en la municipalidad. Con esos precedentes, no faltan los que sostienen que la deriva de Godoy no es más que el perfeccionamiento de una supuesta maquinaria de defraudación de recursos públicos que ya estaba instalada antes de su llegada al edificio de Plaza de Los Héroes.
Los últimos seis meses de Soto
En el período abarcado por la investigación de Contraloría, hay cerca de seis meses de la gestión del cuestionado edil anterior. En ese período, aparecieron hechos que eran vox populi en los pasillos de Cormun, como el pago a seis trabajadoras entre enero de 2020 y julio de 2021 de un monto fijo por concepto de horas extraordinarias ascendiente a $45.298.317, que el área de Recursos Humanos de la Corporación explicó que sirvieron para asimilar un bono de responsabilidad. Sin embargo, no hubo antecedentes formales sobre dicho pago, por lo que la Corporación está obligada a reintegrar ese dinero en no más de 60 días hábiles.
También en el listado de adquisiciones por un total aproximado de casi $1.500 millones relacionadas con las denuncias por presuntas irregularidades aparecen algunos proveedores recurrentes del ex alcalde de Soto como Inversiones EIRL, Sergio Caro e Inversiones Trigo por un monto próximo a los $ 600 millones. En esas gestiones, se verificaron “debilidades generales de control interno”, “organigramas desactualizados”, “carencias de manuales de procedimientos”, “carencia de manuales de funciones y descripción de cargos”, “situaciones de riesgo no controlados por el servicio” que son comunes a ambas administraciones.
Precisamente, en el ámbito de las compras, el informe de la Contraloría refiere que el límite a los tratos directos fue una restricción que se puso la misma Corporación en su reglamento de adquisiciones de 2017, permitiendo la contratación directa como excepción que debía ser respaldada por un acto administrativo fundado en situaciones de emergencia, imprevisto, sismos y catástrofes. Sin embargo, la CORMUN autorizó la contratación directa para el período 2021 por la suma de $401.984.156, para la adquisición de diferentes bienes y servicios, sin el respaldo del acto administrativo. Y establecía la necesidad de una o más cotizaciones de varios potenciales proveedores, según el monto de la compra.
En el anexo III, página 117, “Falta de acto administrativo que apruebe la contratación directa”, en el informe aparecen esas irregularidades y varias de ellas cubren el mandato de Eduardo Soto, como las siguientes:
Es decir, en el total de compras directas sin acto administrativo pertinente de casi 402 millones de pesos, el 54% corresponden a los postreros seis meses de Eduardo Soto como presidente de la corporación y como alcalde de Rancagua. Imaginemos si la investigación hubiese cubierto el año anterior.
El hecho es que en el largo listado de compras directas, vulnerando el reglamento de compras, sin respaldo legal o cotizaciones previas, los nombres de varios proveedores del período Soto se repiten: Inversiones Mathias Pozo Mardones, Sergio Caro Calquín, Magaly Trigo Morales, Cristian Trigo Morales, Asociados Salas Spa, GNB Ingeniería y Construcción, Ethon Pharmaceuticals, RCJ Ingeniería y Montajes, Juan Jara Escobar.
Sumando los gastos improcedentes por distintos conceptos, solo 6 meses de la gestión de Soto ponen luz sobre $ 570 millones de pesos adjudicados a proveedores sin los procesos respectivos. Surge la misma duda respecto de que habría pasado si la revisión de la gestión del edil ex UDI se hubiese extendido, por ejemplo, a todo su período, o más allá, dado que fue reelecto en varias oportunidades.
Godoy y Soto fuera de circulación
En los días posteriores a que Paulina Vodanovic, presidenta nacional del Partido Socialista, tuviera conocimiento del informe de Contraloría había cierta tranquilidad en su entorno, lo que se reflejó en las declaraciones que emitió a TV13: “si hay irregularidades o delitos, porque las cosas hay que llamarlas por su nombre, nosotros como partido vamos a ser rigurosos en pasarlos al tribunal supremo y que se adopten ahí las medidas que el tribunal determine”. Es bien probable que la tranquilidad estuviera acompañada por el cálculo: el informe de Contraloría dejaba también a Soto “fuera de circulación”.
En declaraciones efectuadas a este medio, Hugo Guzmán, concejal que ha liderado la fiscalización al actual alcalde, señaló que en el período investigado por la Contraloría y en el último año, sobre el cual él y otros concejales han demandado investigación “se cometen faltas administrativas, irregularidades y procesos mal ejecutados, tratos directos no acreditados con omisión de procesos de cotización, también fragmentación de compras para poder evitar las licitaciones. Básicamente se presentan las mismas situaciones, es decir, la administración de Cormun siguió operando de la misma manera entre los mandatos de Eduardo Soto y Juan Godoy”.
Como se sabe, las conclusiones de la investigación ya están en el ministerio público y en el CDE a la espera que, esta vez en Rancagua, sí haya sanciones. Una expectativa que, en más de una ocasión, se ha visto frustrada, sin que las responsabilidades políticas y penales sean pagadas por quienes han hecho del servicio público un coto privado de caza.
