En nuestra región, la actuación de Esteban Valenzuela como ambientalista desde hace años, asusta a un tipo de empresario agrícola depredador de la naturaleza y de sus recursos. No sabemos si el ministro de Agricultura sobrevivirá a una tercera embestida. La alternativa a su caída es limitar de antemano su capacidad de gestión que busca articular un programa de tránsito a una economía circular que vaya por la senda de enmendar el modelo de agricultura.

El miércoles pasado, 9 de marzo, un día antes de que el nuevo presidente asumiera junto con su gabinete, La Tercera a través del periodista Juan Manuel Ojeda lanzó un misil a la línea de flotación del nuevo ministro de Agricultura.
En un tiempo de carencia de utopías y de raquitismo del relato político, la política se ha desnudado como un mero juego de egos, en el que el asesinato político por encargo se ha evidenciado como un recurso al cual los actores políticos y los poderes fácticos, están recurriendo cada vez más con mayor frecuencia. Basta mirar cómo se ha ido sembrando un manto de duda sobre el accionar de la Convención, tras el cual ya se adivina la articulación de intereses transversales por hacerla fracasar.
Algo de eso le sucedió a Daniel Jadue, incluido errores propios, durante las dos últimas semanas previas a la primaria; lo mismo le pasó a Karina Oliva –hasta el momento no hay ninguna formalización, porque parece que en aquello de lo que la acusan no hay delito – justo a cuatro días de las elecciones, cuando todas las encuestas la daban muy por encima de la candidata comunista, Claudia Pascual e incluso con la posibilidad de arrastrar a quien le secundara en su lista.
Por igual situación pasa Esteban Teo Valenzuela desde que fue nominado como futuro ministro de Agricultura por la actual administración. El mismo día de su designación recibió no solo el dardo cercano de su compañera de colectividad, la senadora Alejandra Sepúlveda, quien cuestionó sus competencias para el cargo, sino esa misma jornada, se hizo pública la disputa judicial con la empresa agrícola Tralcan, de propiedad de Nicolás del Río, del clan con inversiones en Falabella. Se puso el énfasis en su condena por injurias sin mencionar la lucha medioambiental que él y la organización Bosques para Cachapoal había dado, ni explicitar el trasfondo de la disputa: la tala ilegal de bosque nativo.
El problema de fondo lo ha reporteado en varias oportunidades El Mostrador en Muertes, suicidios no esclarecidos y amenazas: los peligros que enfrentan los activistas medioambientales en Chile, o Acusan a hijo de José Luis del Río de tala indiscriminada de bosque nativo para plantar paltos, y La denuncia del próximo ministro de agricultura, Esteban Valenzuela, que permitió la paralización de permisos irregulares de palteros, y en mi columna El Mundo al revés. El asunto es mucho más complejo que lo señalado por los medios cuando Valenzuela fue designado ministro de la cartera el viernes 21 de enero, los que pusieron el foco en la querella y la condena y no en la causa medioambiental que había encabezado. El contexto es una mezcla de abuso de poder, permisos truchos como los que otorgó Conaf y sendas resoluciones de Contraloría al respecto. Luego de los hechos ocurridos en el cerro El Chivato de Las Cabras, de los que solo se difundió la semana pasada un segmento de un video que dio pie a la acusación contra el ministro de actuar “alcoholizado”, el entonces activista interpuso una demanda medioambiental que fue respaldada por la entonces diputada Alejandra Sepúlveda, quien también realizó gestiones en favor de detener la tala ilegal de bosque nativo.
Es decir, la disputa medioambiental con una arista judicial era de público conocimiento desde hace mucho tiempo, incluso fue tema de una escuela de verano de la agrupación Bosques para Cachapoal, y sobre esa arista no había ninguna novedad. Los cuestionamientos al nuevo ministro de Agricultura tienen dos hitos coincidentes: las destempladas declaraciones de la senadora electa por la región y de una parte de la prensa tradicional, que emiten una versión bien sesgada de la controversia y la difusión de la condena y el juicio contra Valenzuela, al momento de la designación del primer gabinete del actual presidente. En la controversia, no se consideró la justicia del alegato ni el trasfondo ilegal del permiso con que operó Tralcan en una región que lleva años con sequía; se puso el foco solo sobre el ministro y no en la empresa infractora ni su vínculo con la familia del Río. La intencionalidad era clara: deslegitimar desde un comienzo al nuevo secretario de estado, poseedor de un perfil, historia y trayectoria ambientalista en una región donde el abuso de los agricultores de monocultivo tiene a comunas como Lolol, gastándose ya el 10% de su presupuesto anual en el reparto de agua con camiones aljibes. La situación, que hemos denunciado en páginas de El Regionalista con crónicas sobre la situación en Lolol, Las Cabras y el Alto Tinguiririca, se seguirá agravando cada año, pese a lo cual no se pone fin a los permisos de monocultivos. La inmovilidad de los entes reguladores fue abordada en la reunión de autoridades regionales, en agosto pasado, por el director General de Aguas (DGA), quien llamó a poner fin a la entrega de permisos de esa índole.
El tono de esta disputa medioambiental, al poner el foco en la condena por injurias del nuevo ministro, sin enfatizar su claro perfil medioambientalista, pareció digitada por fuerzas oscuras e influyentes, concertadas para buscar su caída o, al menos, su debilitamiento político.
En una segunda oportunidad, el proceso judicial de Esteban Valenzuela saltó nuevamente a dominio público dos días antes de la asunción del nuevo gobierno. De tan obvia, la sospecha también la asumió el propio Tomás Mosciatti, quien se preguntó ese día en Bío-Bío “por la ocasión en que el tema se lanza nuevamente a la luz pública”. Porque la difusión de la noticia nuevamente contaba una parte de la historia, con un video editado, donde evidentemente Esteban Valenzuela dice palabras que no debió haber dicho, pero había que estar ahí para calibrar la dimensión del conflicto con la empresa Tralcan, que venía de meses, cuando vecinos y Bosques para Cachapoal comenzaron a hacer denuncias sobre la tala ilegal de bosque nativo de parte de la empresa de Nicolás del Río.
Es curioso, además, que el misil al corazón del gobierno y al cuerpo del propio ministro, se lance no solo 48 horas antes de ponerse en escena la nueva administración sino también, y esto es importante, en el contexto del escándalo en el Ejército por el mal uso de dineros, hecho que había provocado la renuncia de su comandante en jefe, Ricardo Martínez, la semana anterior. Martínez no se había presentado a declarar ni asistió a la entrega del mando el miércoles 9 al nuevo comandante, el general Javier Iturriaga, ceremonia que encabezó el presidente Piñera y a la que asistió incluso Maya Fernández, la nueva ministra de Defensa de Gabriel Boric. Aquello que debió haber sido titular ese día fue reemplazado por una primera página de La Tercera que no se apega a la verdad, ni a un enfoque periodístico de la trama Tralcan y la tala ilegal de bosques. Se hace cargo de dichos de una de las partes (“alcoholizado”, sin que hubiese habido un alcotest), ni se enfoca en la irregularidad de la formalización pendiente de parte del fiscal a cargo, pues se invoca amenazas y la violación de morada, cuando todo abogado sabe que este delito está claramente tipificado en la legislación chilena actual y las amenazas sólo pueden ser tales cuando se manifiestan conductas ilegales y precisas. Es decir, “te voy a pegar”, “te mataré”, etc… Por lo demás, y según los propios videos que circulan, no hay ninguna casa cerca del área donde se produjo el incidente –solo se pueden ver cerros literalmente “pelados”- y se observa que Esteban Valenzuela en ningún momento hace amago de querer entrar a la morada del denunciante. Está, al parecer, de paso por un predio ajeno.
Como nos lo explicó bien el abogado Roberto Ávila: “Esta voz morada, reemplazó a la antigua «violación de domicilio», de esta manera es delito entrar sin permiso o contra la voluntad en el lugar donde una persona vive. Morar es habitar, vivir. En derecho penal todos los delitos y tipos penales se interpretan restrictivamente. Por lo tanto, no todo el predio es morada, pues el bien jurídico protegido, lo que el derecho defiende, es la intimidad, en este caso del hogar o vivienda.
Como se observa en el video que circula, el ex parlamentario en ningún momento intenta entrar a la casa, a la morada, sino que está de paso. Si lo hace sin permiso, eso, a lo más, da lugar a una acción ante un Juez de Policía Local, pero nunca es un delito. Argumento per absurdum, es sostener que el tipo penal protege todo el predio incluso lo no construido, lo que implicaría que si ingreso a un terreno de mil hectáreas en un lugar donde ni siquiera se ve una casa habitación, cometo violación de morada.
Pero lo anterior no ha estado en ninguna de las notas, ni reportajes que se han escrito sobre el asunto Tralcan y la tala ilegal de bosques. En el foco del huracán ha estado ese incidente en una perspectiva que evidentemente deja mal parado al actual ministro. Lo comprobamos en un almacén en Rinconada de Molineros (Peralillo), cuando pasamos a comprar a la hora de comer y la noticia estaba en los canales, en este caso T13; le indicamos a la almacenera que lo conocíamos y le dimos detalles del asunto y su respuesta al final fue: “gracias por explicármelo, porque si me quedo con lo que dice la tele, el malo es él”.
Me llega el rumor que un destacado parlamentario gremialista de esta región fue cuestionado por una par sobre el motivo por el cual su partido no criticaba al ministro, recibiendo como respuesta “esa es una pelea entre ustedes, no es nuestra”.
Epílogo: ¿caerá Teo?
En nuestra región, la actuación de Esteban Valenzuela como ambientalista, desde hace años asusta a un tipo de empresario agrícola depredador de la naturaleza y de sus recursos. No sabemos si el ministro de Agricultura sobrevivirá a una tercera embestida que, seguramente, vendrá pronto para hacerlo caer definitivamente. Porque la alternativa a su caída es limitar de antemano su capacidad de gestión que busca articular un programa de tránsito a una economía circular que vaya por la senda de enmendar el modelo de agricultura. En ese contexto se entienden las palabras del presidente de la SNA, Cristián Allendes quien desdramatizó la querella, pero a la vez señaló que “Los bosques no son bosques. Son algunos árboles. Muchos sectores fueron sembrados hace 50 años”, e indicó que esos bosques “se limpiaban y se reemplazaban por frutales, que eran muchos más árboles”, pues “queríamos que se siguiera haciendo beneficios en zonas agrícolas para mucha gente; para dar trabajo, para dar mejor economía para esas regiones”.
A buen entendedor, pocas palabras.
