Si el fallo de tribunales de noviembre pasado parecía claro en su mandato a las isapres de devolver cobros ilegales a sus afiliados, las declaraciones de la hoy ex vocera de la Corte Suprema, Ángela Vivanco, sembró la incertidumbre y pareció dar un hálito de esperanza a las isapres. Pero la resolución de la Tercera Sala de la Corte Suprema de este viernes en respuesta a diversos recursos de aclaración confirmó lo que puso en duda la ex vocera. Sin embargo, más allá del pronunciamiento, es digno destacar que desde hace 20 años, más menos, son los tribunales de justicia quienes están resolviendo las materias que el sistema político no es capaz de procesar. En este caso, la sala donde señorea la emblemática figura del ministro Sergio Muñoz, ha sido contundente en favor de los consumidores y ciudadanos.
El Regionalista, en exclusiva, tuvo la oportunidad de sostener un diálogo fluido con quien encabezara, como presidente de Conadecus, la crítica frontal a la operación que estaban realizando las isapres en pos de la anulación del fallo del 30 de noviembre pasado.
-¿Cuál es tu opinión respecto del pronunciamiento de la Tercera Sala de la CS?
Bueno, creo que la Tercera Sala, una vez más, se hace notar en defensa de los ciudadanos e indica que no hay que innovar, no ponerse creativos, la resolución de noviembre pasado es de carácter general y unánime: las isapres tienen que devolver lo mal habido. La discusión que abrió la ministra Vivanco fue innecesaria, la corte fallo y dijo, no hay segundas interpretaciones sobre la resolución.
También la decisión es un contundente mensaje a un gobierno que intentó por todos los modos dilatar el fallo, un gobierno que en este tema siempre anduvo bien perdido, así como para la superintendencia, que no hizo nada para exigir a las instituciones de salud que cumplieran el fallo. Se debe saber que las isapres se han burlado hasta hoy en la propia cara de la superintendencia, no solo no devolviendo el dinero, sino también, han continuado aplicando tablas discriminatorias, haciendo caso omiso a la super.
-Las isapres ¿están en condiciones financieras de pagar?
No entiendo el llanterío de ellas por no pagar, que no se condice con los gastos administrativos que tienen, cercano a los 300 mil millones de pesos, más menos, U$ 500 millones, que gastan en costos administrativos anuales.
-Explícanos eso, cuando uno ve que la mayoría de ellas ya ni siquiera tienen oficinas.
Por eso estamos pidiendo la intervención de un administrador provisorio, para que aclare ese nivel de gastos, cuando apenas tienen oficinas en algunos lugares, y dos o tres funcionarios. Este gasto administrativo exagerado, serviría para pagar toda la deuda con sus afiliados en un par de años. Cuando una industria habla de la posibilidad de una quiebra, no puede ser que esté gastando U$ 500 millones. Hay que preguntarse dónde se está yendo ese dinero, en que incluso han hecho aportes a políticos con nombre y apellido.
-¿Este es un golpe duro también para los actores políticos que intentaron mediatizar las consecuencias del fallo de la CS?
Sí, es un golpe duro para ellos también, los que intervinieron proponiendo medidas que iban en favor de las isapres. Está claro que la Tercera Sala tiene poderosas razones para fallar en contra de los cobros excesivos. Recuerda tú que lo que deben devolver no son excedentes, son cobros que se hicieron a sus usuarios al margen de las tablas indicadas por la propia Superintendencia. En castellano, es un cobro indebido, al margen de la ley, que estas instituciones hicieron a sus usuarios. Y que hasta hoy mantienen, burlándose en su propia cara del gobierno y de la super al no acatar la decisión de la CS. Si fuese cualquier ciudadano de a pie quien no acatase un fallo de tribunales, no te quepa la menor duda de que estaría ya preso, pero estos señores no lo están. Así es la ley del embudo en Chile.
– ¿Qué hará ahora Conadecus?
Nosotros estamos solicitando la intervención de las isapres, y lo venimos pidiendo desde hace mucho tiempo. Esta es una industria con un nivel de opacidad tremendo, que tiene poca transparencia; si uno compara la infraestructura que tienen con la calidad del servicio que prestan, no se explica el gasto administrativo en que incurren. Debo señalarte que antes ha habido intervención de esta industria, cuando algunas isapres estuvieron a punto de quebrar. El interventor en aquella oportunidad ordenó sus gastos administrativos, ordenó las cuentas y las isapres intervenidas no quebraron. Tan simple como eso.
