De niña, mi mamá me conto sobre aquel plebiscito, donde solo los valientes se atrevieron a votar contra la Constitución de 1980, con susto de las armas y poder de los militares, riesgo de muerte, exilio y tortura, no sabemos si el triunfo de esa vez fue fruto de fraude o miedo, pero sí sabemos que, con esa carta fundamental, nuestro país se hundió en el libre mercado, vendiendo desde el agua hasta los derechos sociales y humanos.
Hace unos 15 años comencé a escuchar el llamado a la Asamblea Constituyente, el movimiento de los pueblos, marca AC en tu voto y con Bachelet 2 llegó para instalarse el cambio hacia una nueva Constitución. No digo que lo que sucede ahora sea fruto de ese gobierno, ya que para quienes trabajamos por AC y nos sentíamos desilusionados de la Nueva Mayoría la invitación de Bachelet, más que alegrarnos nos daba temor porque nos generaba desconfianza. Queríamos algo que realmente fuera representativo, con participación vinculante, asambleas, cabildos y sueños.
Para el estallido social, germinaron encuentros ciudadanos, se multiplicaron las plazas de la dignidad y los cabildos comenzaron a ser sistematizados por grupos autoconvocados que buscaban dar un relato y propuestas a lo que estaba sucediendo. Puede sonar fuerte eso de que no son solo 30 pesos, y en medio de la violencia institucional y la defensa de la primera línea, más los vándalos y camuflados que se aprovecharon del momento surgió el acuerdo por la paz, como una medida para realmente hacer un cambio profundo, no más Constitución de Pinochet, el último legado estructural del dictador.
Hoy estamos viviendo un proceso histórico que nos llevará a tener un nuevo acuerdo de cómo queremos habitar nuestro territorio incluyendo a la naturaleza, pero, como todo proceso, tiene sus sombras y sus luces, y aspectos que definitivamente sería bueno “compostar”.
Lo bueno
El estar haciéndolo, como sea, con los colores y tonos que termine el nuevo producto de la fábrica constituyente será mejor que la Constitución del 80. No hay dudas, no nos perdemos en eso. La gran presencia de movimientos sociales, ecologistas, activistas, ñañitas, indigenistas, constitucionalistas, patipelados y poderosos, mujeres, hombres, disidencias, todo hace una mixtura biodiversa que debiera ser el reflejo de los pueblos de Chile, sus sueños y necesidades. Que toda esta gente sea capaz de encontrar los modos de dialogar y decidir para escribir una constitución, es maravilloso. Estas personas, constituyentes junto a sus asesores están en un trabajo muy exigente y le ponen el hombro, el corazón, las ganas y la mente.
Que se esté hablando de girar el péndulo desde donde se toman las decisiones, desde un estado regional, con autonomías, donde podremos influir desde lo local con participación real de las comunidades.
Los derechos de la naturaleza, que sea considerada un ser sujeto de derechos para que su daño sea castigado, y en general todo el entendimiento de los temas ecológicos, donde se está reconociendo como un principio el de interdependencia con ella.
Tener un estado plurinacional, que se ve cimentado entre diferentes naciones, con costumbres, idiomas, cosmovisiones y herencias propias, donde también se reconocen las múltiples y diversas culturas que lo componen, y desde ahí hacerse cargo de que los derechos fundamentales y la justicia sean concebidos desde la equidad e igualdad.
No quiero entrar en detalle de lo que queda en la nueva Constitución, será materia de otro escrito, pero si debiese decir ¿qué es lo mejor?: solo diría el hacerlo, el transitarlo, el intentarlo y el lograrlo
Lo malo
Definitivamente, el acuerdo por la paz abrió esta puerta, pero también trajo muchas trampas y el tiempo es, quizá, la más feroz de todas; el plazo dado es, por decir lo menos, ilusorio. Lo más seguro es que se cumpla, pero los costos de eso serán altos. El día a día en la Convención, y de quienes trabajan en ella, se inicia con reuniones de colectivos a primera hora, para después -a las 9:30 de la mañana- empezar sesiones de comisiones o pleno. Luego, el almuerzo, generalmente en reunión donde se sigue trabajando por lograr los consensos, para, desde las 15:00 horas, iniciar el pleno que puede extenderse hasta la 1 o 2 de la madrugada. Así es de lunes a sábado, mientras los convencionales están en eso, votando, deliberando, los y las asesoras están haciendo comparados, leyendo gran cantidad de propuestas, minutas e informes para llegar a la tan anhelada norma de los 2/3. Y como el tiempo es corto, el cansancio ya se siente en todo el ambiente, la gente se sostiene en la convicción, e incluso en el miedo porque, si piden más tiempo para terminar el trabajo encomendado, la opinión pública, orquestada por quienes siguen el rechazo, hará un uso inadecuado de esta justa necesidad, ya que todo sirve para el rechazo.
Los 2/3 nos presentaron una barrera muy compleja, por un lado invita a hacer los consensos y diálogos que permitan llegar a él, se busca “amarillar” la norma lo suficiente para no correr el riesgo de perder lo mínimo necesario, el límite entre esa esencia y perderla es complejo de ver con la presión de la rueda que no para, que obliga a diálogos que, en muchos momentos, chocan con el tiempo. Por otro lado, los 2/3 son el vehículo para lograr una Constitución que nos represente a todos.
En la Convención, mucho se habla del buen vivir, pero la forma y tiempos de ella distan de estar realmente vivenciando ese principio: la máquina está pasando y fuerte, la del tiempo y la otra, esa que no nos gusta.
Lo feo
En todo este entramado de sueños, falta de tiempo y diálogos por el consenso, surgen los modos de aquella política que queríamos dejar fuera y que, con la llegada de mucha gente desde el mundo independiente, se pensaba que se podría superar; no, la política que no entiende lo que es la “poliética”, deja de lado los diálogos horizontales, se trabaja en bloques y grupos sectarios, en una cocina que muchas veces tiene un sabor amargo. Los poderosos de siempre con los 2/3 están siendo lo suficientemente astutos como para comerse a quienes no tienen experiencia.
Con argumentos técnicos de “mala redacción” se bajan iniciativas para ser mejoradas y en muchos casos perder su esencia y, en otros, de lleno dejarlas fuera. No digo que todo esté escrito perfectamente, pero hay una diferencia notable entre mejorar algo y cercenarlo.
Paso a paso
Claro que no todo está perdido, porque los 2/3 nos dan una validez increíble, obviamente mucho mayor que la de un plebiscito a punta de fusil, se está avanzando, y están quedando normas que reflejan el sentir popular, quizá no todas las que soñamos o vimos perfectas, pero la verdad es que eso también es una ilusión, la perfección ¿de quién?, ¿desde qué verdad?, ¿desde qué realidad?
Esta Constitución será un peldaño más para quienes queremos transformaciones profundas. En permacultura hablamos del tránsito, comunidades que caminan a un nuevo modelo sustentable y regenerativo, acá es lo mismo: los cambios se dan paso a paso. Para “mi Constitución ideal”, habría que hacer desaprender muchas cosas con un cambio de paradigma profundo, desde el biocentrismo, pero sé que eso no es aún consenso de 2/3. Aunque, también, he visto que muchos dentro de la convención están a mil, permeando al pleno de los temas importantes. Me sentí orgullosa al conversar con un querido asesor, quien me dijo que antes de entrar no sabía nada de ecología y ahora sabía mucho, y podía comprender mejor desde dónde hablábamos, lo mismo con otros temas, son tantas áreas que se están viendo al mismo tiempo, es tanto el aprendizaje, la concentración y la pasión, que el fruto de este encuentro solo traerá buenas luces. No lo dudo ni un segundo.
Ahora es cuándo
El llamado ahora es a informarse bien del proceso: pueden desde ya leer las normas que están siendo parte del borrador de la nueva Constitución y, por supuesto, apoyar este momento en que los partidarios del rechazo aprovecharán cada instancia para distorsionar desde la desinformación a las personas. Entre todas y todos podemos volver a aprobar.
