Hugo Guzmán, patrocinante de la presentación, manifestó a El Regionalista que, más allá de la resolución del órgano contralor: “queda en evidencia que el alcalde Godoy siempre ha tenido una forma de disminuir y/o minimizar la acción del concejo, nos ha mirado por sobre el hombro. Contraloría nos encontró la razón, dice que lo hicimos bien, esto demuestra que el alcalde o no conoce los procesos administrativos o se los salta deliberadamente.

El documento digital de Contraloría, con la resolución sobre el requerimiento de un grupo de concejales encabezados por Hugo Guzmán, Valentina Cáceres, Maricarmen Orueta y Emerson Avendaño, salió con dirección al correo electrónico de uno de ellos el pasado miércoles 19 de octubre. El documento, firmado por la directora regional de contraloría, Rocío Ortiz Pérez, cuyo título era “NO RESULTA PROCEDENTE LA RENOVACIÓN DE LA CONCESIÓN QUE SE INDICA, POR LAS RAZONES QUE SE EXPONEN”, fue preciso y escueto y resolvía lo siguiente, en relación a la ampliación del contrato con la empresa actual: “así, la extensión de contrato aprobada en una segunda oportunidad a través del decreto alcaldicio N°2.677, de 2022, excedió los términos de referencia, como también la preceptiva contenida en el Reglamento de Compras Públicas, por lo que, en la especie, no podía extenderse nuevamente el contrato con la empresa de que se trata. En consecuencia, es posible concluir que, conforme al criterio contenido en el dictamen N°68.473, de 2012, la renovación impugnada no se ajustó a derecho”, motivo por el cual el órgano regional: “instruirá un sumario administrativo en ese municipio a fin de establecer las responsabilidades administrativas que se deriven de la referida infracción”.
Es significativo que Contraloría dirija ese sumario dado que hubo una votación del concejo de fines de agosto, donde, con el voto favorable de los concejales Patricio Henríquez (PS), Manuel Villagra (PPD), Viviana Morales (PC) y Carlos Arellano (PDC), y con el voto dirimente del alcalde Godoy “se legalizó, la ilegalidad” cometida por la administración actual en torno a la extensión del contrato de basura con la empresa Veolia.

A su vez, la sede local de Contraloría reiteraba que, de cualquier modo, el municipio debe adoptar las medidas pertinentes para: “que la continuidad del servicio de aseo no se vea afectada por circunstancias que le son imputables y que han impedido, a esta data, que el servicio concesionado en análisis, se hubiere adjudicado en una nueva licitación pública”.
Por último, y en relación a la queja de los ediles querellantes, que la aprobación de la extensión no habría pasado por el concejo municipal, el ente fiscalizador regional resolvió que: “en relación con lo anterior, debe indicarse que, a través del dictamen N°1.355, de 2018, de esta Entidad Fiscalizadora, se concluyó que, en las concesiones de servicios, el acuerdo del concejo debe ser previo a la suscripción del acto o contrato, cuestión que no ocurrió en la especie, por lo que, en lo sucesivo, ese municipio deberá abstenerse de incurrir en tal conducta”.
Inmediatamente publicitada la resolución, los concejales firmantes de la presentación, emitieron una declaración pública, donde emplazaron al alcalde Juan Godoy a “dar una respuesta ante el concejo municipal y los ciudadanos», pues él declaró públicamente en medios de comunicación que «la extensión del contrato de basura no requiere pasar por concejo municipal” y, además, acusó a los concejales de realizar un ataque político, declaraciones que carecen de razón y fundamento. «Juan Ramón Godoy, constantemente ha señalado en concejo municipal que los concejales no conocemos los procesos administrativos, Contraloría ha señalado que es él quien desconoce la ley, ¿o la incumple deliberadamente? En definitiva, los concejales recurrentes teníamos la razón”.

Queda en evidencia que los concejales somos serios, y que el alcalde Godoy no es tan experto como cree serlo, o que por su experticia, tiene la capacidad de saltarse las leyes”.
El concejal frenteamplista se refirió, incluso al escenario político electoral que queda abierto después de esta resolución y a la espera de la decisión del Tribunal Electoral Regional (TER), y la pérdida de popularidad y aprobación de Godoy, tras este dictamen: “sin duda, lo percibimos no solo por lo que está sucediendo al interior del municipio, sino hay una falta a la ley, la percepción que tenemos en terreno, la percepción que tenemos por parte de los vecinos es “no más Godoy”, lo que es lamentable. Teníamos un gobierno comunal distinto, después de doce años de derecha y, a poco andar, se empezaron a detectar todas estas irregularidades. Ya no son presuntas”. Por ahora, “hemos hecho el análisis entre los concejales más de centro izquierda, del frente amplio, y estamos estudiando hacer una primaria lo más amplia para elegir al candidat@ que nos represente a la alcaldía en el próximo periodo”, sentenció.

El Regionalista consultó a diversos expertos municipales en el tema y coincidieron en que, con “la contundente resolución de Contraloría”, se fortalece la posibilidad de un notable abandono de deberes del actual alcalde de Rancagua, situación que resolverá el TER. “Cuando Contraloría emite dictámenes siempre son un poco cantinflescos, dicen una cosa, pero dejan la puerta abierta a otras, pero, en este caso, la resolución es contundente y no da lugar a dobles interpretaciones”, señaló un conocido, especialista en el tema.
