Se ha podido observar la extensa difusión de tergiversaciones de diverso calibre sobre el texto de la nueva Constitución. Algunas no argumentan nada, simplemente falsean, y otras son un poco más elaboradas, pero con una notoria falta de honestidad intelectual. Todas ellas tienen muy poco que ver con lo que se votará el 4 de septiembre de 2022.

1. El proyecto de nueva Constitución no le quitará la casa a nadie, como se ha afirmado de manera deshonesta. Basta ver el artículo que garantiza la propiedad sobre todo tipo de bienes para darse cuenta de que, si alguien es dueño de una casa, su propiedad estará protegida por la Constitución. El artilugio se ha construido a partir del artículo que señala que existirá un derecho a la vivienda, lo que manifiestamente no tiene nada que ver con expropiarle la casa a nadie. Por supuesto, existen normas de expropiación por interés público puntual, como en la actualidad, con indemnización al precio justo, concepto jurídico de amplio uso. De otro modo no se podrían construir infraestructuras ni urbanizaciones.
2. En el tema de la propiedad del agua, se establece su carácter público y asignable a usos según prioridades. Los que consideran esto una expropiación, no deben olvidar que las aguas se definen en la ley vigente como un bien nacional de uso público, lo que es una práctica mundial. Si hasta aquí se ha abusado de la figura de la concesión, establecida en la Constitución de 1980, la nueva norma no hace sino corregir una anomalía. Y si hay bancos que han aceptado como garantía un bien nacional de uso público, es un problema de mala evaluación de activos por el parte del banco y de nadie más.
3. En materia fiscal, cabe consignar que la nueva Constitución no va a subir ningún impuesto, pues solo enuncia principios generales y remite esa materia a la ley. En cambio, obligará a la responsabilidad fiscal en el gobierno central y en las regiones y municipios de una manera mucho más perentoria que la norma constitucional vigente. El ejecutivo mantiene la potestad exclusiva sobre el gasto público, sin perjuicio de que formaliza un derecho de petición de gasto del parlamento que ya existe de manera informal y se practica cotidianamente. Nada muy nuevo bajo el sol en la materia.
4. A su vez, la nueva Constitución no incluirá ninguna medida contra la inversión, como vienen sosteniendo los agoreros de las pasiones tristes. La libre iniciativa económica se garantiza y, al igual que en la actualidad y que en todas las democracias maduras, tendrá cómo límite el interés público, la protección del medio ambiente y el respeto de las normas de protección del trabajo. Existirá, además, el fomento de la propiedad cooperativa y social y una propiedad pública de los recursos del subsuelo y del mar y de las áreas terrestres protegidas. Se podrán crear por ley empresas del Estado o mixtas. En materia de pensiones, salud y educación se garantiza un derecho de acceso, pero no se excluye la participación parcial de privados.
5. En materia de régimen político, el debate es amplio y las opiniones contrastadas. Nunca podrá satisfacerse todas las opiniones en ninguna formulación específica, pues hay legítimas preferencias para todos los gustos, como también se observa en las diversas democracias maduras y en el constitucionalismo comparado. La nueva Constitución eliminará el Senado, pero creará la Cámara de las Regiones, la que tendrá incidencia en las reformas constitucionales, el presupuesto, los nombramientos y las leyes de interés regional.
6. Cabe convenir que el proyecto de nueva Constitución configura un régimen de separación de los tres poderes públicos principales (ejecutivo, legislativo y judicial) y establece diversos órganos autónomos de esos tres poderes. Evidentemente, la generación de sus autoridades se vincula a órganos expresivos de la voluntad popular, como debe ser en toda democracia, lo que se traduce en la difusión de la sospecha de “control político” sobre esos órganos. La otra solución es la de elegirlos por sorteo, pues cualquier fórmula que se imagine tendrá influencia política, incluso la de una pretendida neutralidad de los “técnicos”. En democracia, las personas que gobiernan los órganos públicos deben provenir directa o indirectamente de la voluntad popular. Cuestionar ese principio es simplemente cuestionar la democracia, lo que muchos hacen al acusar de “politización” a la política y a la esfera pública. El gobierno elegido periódicamente por mayoría no va a controlar todo, sino solo las tareas del poder ejecutivo, sujeto a los debidos controles políticos, administrativos y judiciales, con una administración que debe ser profesional y basada en el mérito. Pero en el parlamento, las mayorías, como corresponde a un orden democrático, van a poder legislar sin los vetos ilegítimamente impuestos por una minoría como hasta ahora.
7. En especial, el proyecto de nueva Constitución asegura la plena independencia de los fallos de la justicia, dejando la carrera de los jueces en manos de un Consejo pluralista y especializado para evitar el corporativismo. La nueva justicia indígena estará sujeta a los fallos de la Corte Suprema. De paso, mencionemos que todos los cuestionamientos al reconocimiento en diversas instituciones de los más de dos millones de personas pertenecientes a los pueblos originarios en Chile expresan más bien una visión racista que una preocupación auténtica por un Estado que reconoce diversas naciones en su seno.
8. En cuanto a la plurinacionalidad, la nueva Constitución no desintegrará el territorio, sino que permitirá descentralizar la administración en lo que corresponda y otorgar un reconocimiento y autonomía indígena en el marco de un Estado único e indivisible que mantendrá las políticas nacionales necesarias para que se ejerzan los mismos derechos en todo el país.
Las reformas constitucionales en los temas más importantes se pondrán en manos de la ciudadanía a través de plebiscitos, en vez de un parlamento en el que basta una minoría de un 1/3 en alguna de las Cámaras para que no haya reforma en las cuestiones principales. Esto le da en la actualidad a la derecha un poder de veto ilegítimo para mantener la actual constitución y el orden económico oligárquico. Eso es lo que se esconde bajo la falsa apelación de “acuerdos” y “consensos”, en su momento necesarios para terminar con la dictadura, pero que devinieron con el tiempo en la imposición sistemática de intereses que no son los de la mayoría, contra lo cual la ciudadanía terminó rebelándose y dando lugar al actual proceso constituyente.
