El derecho a la propiedad: ¿cómo cambia en la nueva propuesta constitucional?

Mucho se ha dicho sobre el derecho a la propiedad en la nueva Constitución. La realidad es que dicho derecho sigue estado garantizado en la propuesta constitucional, pero con diferencias en la adquisición, forma de limitarlo o privarlo, que no dejan de estar exentas de polémicas, pues no existe un conceso en cuanto a si esas diferencias son más ventajosas o desfavorables que las que existen actualmente.

Para comenzar este análisis, me resulta relevante que aclaremos qué es el derecho de propiedad en la práctica. Si buscamos la definición de propiedad, encontramos en la RAE, dentro de primera acepción, que es el: “derecho o facultad de poseer alguien algo y poder disponer de ello dentro de los límites legales”. Luego, también existe una definición legal, en el código civil en su artículo 582, inciso primero, que dice que: “El dominio (que se llama también propiedad) es el derecho real en una cosa corporal, para gozar y disponer de ella arbitrariamente; no siendo contra la ley o contra derecho ajeno.” Aquí, encontramos entonces elementos importantes de la propiedad para entender qué es y cuándo se tiene. Primero, la propiedad se tiene sobre alguna cosa (es ilegal la propiedad sobre las personas), y aquella existe cuando sobre esa cosa yo puedo ejercer goce y disposición, siendo ello no solo un objeto corporal, es decir, aquel que se puede tocar, como una casa, muebles o ropa, sino que también sobre cosas denominadas incorporales que son aquellas que no podemos ver, como la propiedad intelectual, industrial o la que se ejerce sobre una marca). Luego, gozar una cosa, en términos simples, es poder usar o disfrutar algo, por ejemplo, habitar una casa, usar los muebles, manejar un auto, y disponer de una cosa, es ejercer decisión sobre la cosa, por ejemplo, yo puedo arrendar mi casa sin pedir autorización, puedo prestar mi auto, puedo regalar mi ropa.

Entonces, sin ser juristas ni puristas, cuando decimos que, en Chile, se nos reconoce el derecho a la propiedad, estamos diciendo que se nos reconoce apropiarnos de algo para gozarlo y disponer de ello sin autorización ni mas limitaciones que las impuestas por las leyes. Entendiendo el concepto de propiedad, corresponde analizar qué es lo que la actual Constitución reconoce en este derecho y cómo es la diferencia con la propuesta de nuevo texto constitucional.

La Constitución vigente consagra el derecho de propiedad en el artículo 19 N°23 y 24, el cual le atribuyó varias características que se pasan a exponer: 1. libertad para adquirir el dominio de toda clase de bienes (corporales como la casa, ropa, mercadería, auto; e incorporales, como la propiedad sobre una marca, derechos intelectuales, el derecho de una herencia, etc.). 2. Se excluyen los bienes que deben pertenecer a la Nación toda y que la ley los declare así, como plazas, puentes, caminos,), y las cosas que la naturaleza ha hecho comunes a todos los hombres, como el mar, el aire, etc. 3. Es el legislador mediante quorum calificado quien puede determinar limitaciones o requisitos para la adquisición del dominio de algunos bienes. 4. Se reconoce el derecho en todas sus formas (plena, nuda, fiduciaria, indígena, copropiedad, etc.) 5. La privación de la propiedad puede existir cuando se establece con causales, que son la utilidad pública o el interés nacional, calificada por el legislador. 6. Dicha privación, debe ser autorizada por una ley general o especial y se denomina expropiación. 7. Al ocurrir la expropiación, se garantiza al afectado el pago de una indemnización, que cubra el daño patrimonial efectivamente causado (con lo que se excluye el daño moral). 8. Esa indemnización es fijada de común acuerdo o por el tribunal ordinario competente en caso de desacuerdo. 9. Lo indemnizado se paga en dinero efectivo y al contado, a menos que exista acuerdo, en otros términos. 10. También se puede limitar el ejercicio de la propiedad a través de una ley, cuando se motive en la función social (esto con la noción de que la propiedad también implica deberes y responsabilidades) y cuando cuanto exijan los intereses generales de la Nación, la seguridad nacional, la utilidad y la salubridad públicas y la conservación del patrimonio ambiental (ejemplo, cuando se prohíbe remodelar, restructurar o incluso pintar una casa que es considerada patrimonio nacional).

Lo anterior, viene a resumir como está tratado el derecho de la propiedad en la actual Constitución, por lo que a partir de ello se hará la comparación con la nueva propuesta constitucional. La nueva propuesta constitucional, ha consagrado en su artículo 78, el derecho de propiedad, de la siguiente forma:

1. Toda persona, natural o jurídica, tiene derecho de propiedad en todas sus especies y sobre toda clase de bienes, salvo aquellos que la naturaleza ha hecho comunes a todas las personas y los que la Constitución o la ley declaren inapropiables. 2. Corresponderá a la ley determinar el modo de adquirir la propiedad, su contenido, límites y deberes, conforme con su función social y ecológica. 3. Ninguna persona puede ser privada de su propiedad, sino en virtud de una ley que autorice la expropiación por causa de utilidad pública o interés general declarado por el legislador. 4. La propietaria o el propietario siempre tiene derecho a que se le indemnice por el justo precio del bien expropiado. 5. El pago deberá efectuarse de forma previa a la toma de posesión material del bien expropiado y la persona expropiada siempre podrá reclamar de la legalidad del acto expropiatorio, así como del monto y de la modalidad de pago ante los tribunales que determine la ley. 6. Cualquiera sea la causa invocada para llevar a cabo la expropiación, siempre debe estar debidamente fundada.

En primer término, vemos que sí existe el reconocimiento del derecho de propiedad como un derecho fundamental, pues está tratado en dicho capítulo (Capítulo II de los Derechos Fundamentales y Garantías), y existen varias características que están tratadas de igual manera que en la Constitución actual, pero hay otras que evidentemente cambiaron.

  1. Aunque la actual Constitución no lo expresaba de manera explícita, el derecho de propiedad también está garantizado, tanto para personas naturales como jurídicas (corporaciones, fundaciones, empresas, el Estado, etc), se reconoce el dominio en todas sus formas y también permite adquirir el dominio de toda clase de bienes, existiendo una diferencia en este punto. En la Constitución actual, la excepción era que no se puede adquirir los bienes que, por la naturaleza, pertenezcan a todos o a la nación declarable así por una ley, en la propuesta constitucional esta última excepción cambia, y se determinó que no se puede adquirir un bien cuando una ley declare su inapropiación, por tanto, ya no solo son inapropiables los bienes que pertenezcan a todos o sean de la nación, sino que también habrá bienes inapropiables, incluso para el Estado.
  2. Luego, en la nueva propuesta, la adquisición, su contenido, límites y deberes quedaron entregados a una ley que, sin especificar su naturaleza, puede ser de bajo quorum, incorporando, además, no solo el componente de función social, sino que también ecológico, es decir, una ley simple puede regular la manera de adquirir un bien o limitar el ejercicio de la propiedad cuando tenga alguno de estos dos elementos. La diferencia fundamental con la actual Constitución es que era una ley de quorum calificado la única que podía determinar limitaciones o requisitos para la adquisición del dominio de algunos bienes.
  3. En cuanto a la privación del derecho, la propuesta constitucional también establece como forma de privarlo, la expropiación, encontrando también similitudes y diferencias en la forma en que está tratada. En cuanto a las semejanzas, ambos textos establecen que una ley debe autorizar la expropiación y las causales siguen siendo las de utilidad pública o interés general declarado; luego, también se establece el derecho a ser indemnizado por la expropiación y cuando hay disconformidad se establece los derechos a reclamo ante los tribunales. Las diferencias diametrales estriban en que el acto siempre debe ser fundado, es decir, no basta con citar las causales permitidas (de utilidad pública o interés general);  ya no se establece que lo indemnizable es el daño patrimonial efectivamente causado, sino que se indemnizará el justo precio del bien, lo que hoy en día ha causado polémicas, ya que no existe, hasta ahora, un cuerpo que determina qué se debe entender por justo precio, generando distintas posiciones al respecto (el justo precio deber ser el valor del mercado, el valor que las partes determinen, el valor fiscal, etc.); y se elimina la indemnización en efectivo y al contado, dejando al arbitrio de las partes o tribunales la forma y modalidad de pago, pero sí se estableció que este tiene que ser previo al acto material de la posesión.

En conclusión, el derecho de propiedad sigue estado garantizado en la propuesta constitucional, pero con diferencias en la adquisición, forma de limitarlo o privarlo, que no dejan de estar exentas de polémicas, pues no existe un conceso en cuanto a si esas diferencias son más ventajosas o desfavorables que las que existen actualmente.
