La Suprema da la razón a “Salvemos Bucalemu”

El máximo tribunal del país acogió un recurso de protección presentado por “Salvemos Bucalemu”, organización constituida para revertir los catastróficos efectos del muelle de Bucalemu, inaugurado hace unos años, y que amenaza la sobrevivencia del humedal existente en la desembocadura del estero Cabecera. La Suprema paralizó las obras hasta que el MOP realice un estudio de impacto ambiental.

Un nuevo traspié sufrió la intervención del MOP en Bucalemu que desde 2015 ha dado tumbos con su mega proyecto de muelle para el balneario de Paredones.

Esta vez, la Corte Suprema dispuso la paralización de las obras que la Dirección de Obras Portuarias está realizando en Bucalemu con el fin de corregir los graves efectos que ha ocasionado el muelle, inaugurado en 2017, en el humedal que se forma en la desembocadura del estero Cabecera. Con su resolución, la Tercera Sala de la Corte acogió el recurso de protección presentado por “Salvemos Bucalemu”, una organización que agrupa a 40 personas, quienes desde hace unos años desarrollan una campaña para revertir el impacto del muelle en el ambiente.

Hasta ahora, la construcción del muelle ha significado una inversión de casi 7 mil millones de pesos, problemas serios para los pescadores y, quizás más grave por su consecuencia futura, en la práctica se transformó en un muro que impide la comunicación entre el mar y el humedal de la localidad. Esto último, tiene consecuencias catastróficas: al no recibir agua de mar, el humedal tiene hiper concentración de nutrientes, han muerto especies, las aguas han cambiado a color verde y emanan mal olor.

En relación con la actividad pesquera artesanal, el embancamiento producido por la construcción del muelle, ha desplazado el punto de embarque de los botes 100 metros al interior de la playa con el consiguiente riesgo para la seguridad de los pescadores.

“Salvemos Bucalemu” acudió a la Suprema dado que la Dirección de Obras Portuarias se ha negado a participar en las mesas ambientales convocadas por el Ministerio del Medio Ambiente, lo que ha impedido coordinar acciones que permitan neutralizar el daño ambiental provocado hasta ahora. Simultáneamente, la organización ha contado con el apoyo del Instituto de Geografía de la Universidad Católica de Valparaíso que ha realizado estudios que comprueban el impacto negativo del muelle.

En su resolución, la Tercera Sala de la Corte Suprema reconoce los humedales “en tanto sistemas ecológicos relevantes para la humanidad y pilares fundamentales para la mantención y protección de la biodiversidad”, debiendo el Estado brindarles una protección especial y velar por su preservación.

La decisión judicial obliga a la Dirección de Obras Portuarias a paralizar la obra de mejoramiento del muelle “mientras no obtenga la aprobación medioambiental correspondiente”, por lo que deberá ingresar la iniciativa al Sistema de Evaluación de Impacto Ambiental.

Mientras, “Salvemos Bucalemu” sigue desarrollando acciones destinadas a revertir la situación pues sus miembros tienen la convicción que si no hay una intervención que repare el daño, el humedal desaparecerá en los próximos años, lo que dará un golpe mortal a la principal actividad económica de Bucalemu, el turismo.
