Que el tema de las licencias médicas excedió hace rato un uso razonable, es un hecho. Solo basta detenerse en la muy usada expresión “voy a tirar licencia” para entender que el recurso está a la mano, tirar y abrazarse, como se diría en jerga futbolística. Al problema le pone luz el reciente reporte Consolidado de Información Circularizada de la Contraloría General de la República.
El informe exhibe el comportamiento de trabajadores y trabajadoras de 777 instituciones de la administración pública o fundaciones y corporaciones que realizan tarea pública con financiamiento estatal, respecto del uso de licencias médicas entre 2023 y 2024. La auditoría del uso de estas licencias se explica porque los funcionarios públicos siguen recibiendo su sueldo, pagado por el fisco, pese a que la baja por enfermedad implica que FONASA o la Isapre bonifican a la persona cubierta por una licencia.
El hecho es que la Contraloría cruzó la información sobre fechas de licencias con ingresos y entradas en el país y descubrió lo dicho al principio: que el beneficio está sufriendo un atropello que pone en jaque su funcionamiento. Más de 25 mil funcionarios públicos o de entidades privadas financiadas por el erario salieron del país cuando estaban con licencia, infringiendo la ley puesto que el reposo médico solo puede servir para recuperarse, debe ser realizado en el país y exclusivamente donde quien extiende la licencia determine.
Tan grave es lo denunciado, que ya se han alzado voces que, a partir de una aritmética rápida, concluyen que el abuso desvía una cantidad de recursos tan grande que, bien usados, podrían resolver las listas de espera en la salud pública. La primera pista de esas cifras burladas al sistema la da la cantidad de licencias, más de 35 mil, a cuyo amparo esos funcionarios salieron del país. Casi el 70 % de ellas fueron extendidas por FONASA, la entidad de salud estatal.
En un listado de las 777 instituciones con funcionarios que incurrieron en este fraude, publicado por La Tercera, aparecieron entidades que, al menos, llaman la atención. Miembros del Consejo para la Transparencia, por ejemplo, entidad cuyo estandarte es el buen uso de los recursos del país, salieron del país en el marco de tres licencias. De Presidencia de la República, lo mismo, a propósito de 7 licencias médicas. Y se supo de un alto directivo del Ministerio de Energía que debió renunciar por lo mismo.
Y si miramos las cifras en nuestra región, sobre todo los municipios no salen bien parados. Excepto Coinco, en todos hay registro de funcionarios que salieron del país mientras estaban con licencia médica, tanto de la planta propia de funcionarios como de sus corporaciones. La palma se la lleva la Cormun, Corporación Municipal de Rancagua, en el lugar 28 a nivel nacional, con 221 licencias durante las cuales sus titulares salieron del país. Le siguen la municipalidad de Rengo, Santa Cruz, Las Cabras, Graneros, que acumulan el mayor número de salidas del país de sus trabajadores en su tiempo de reposo. El informe incluye al Gobierno Regional, la Corporación Municipal de San Vicente, la de San Fernando, el Servicio de Salud O’Higgins, el Servicio de Educación de Colchagua, la Corporación de la Cultura de Rancagua y la Universidad de O’Higgins.
Este caso, que desnuda un extremo que podía preverse, requerirá capacidad para modificar normas y desplegar las competencias a quienes corresponda. Lo primero, es apuntar a que los funcionarios de instituciones públicas o financiadas con fondos públicos no reciban su sueldo a todo evento cuando están con licencia. Lo segundo es que el subsidio por enfermedad no corresponda exactamente al sueldo que se percibe como si se estuviera trabajando rutinariamente. Es sabido que países que tienen una amplia cobertura social hacen esta distinción a la hora de pagar un subsidio a la persona enferma. Lo tercero es que los empleadores asuman su rol de fiscalización, tal como establece el Decreto Supremo N° 3 del Ministerio de Salud de 1984, cuerpo legal que también le da atribuciones en este campo a isapres, Fonasa y Compin.
No será nada fácil, claro, porque varios de estos vicios sobreviven al amparo del concepto de beneficios.
Sin embargo, intervenir en el problema es tan urgente como prioritario es redestinar los fondos que se malgastan en este ítem en beneficio de las miles de personas que esperan una atención oportuna en la salud pública. O que mueren tras una espera infructuosa.
